Terms of Service
The rules and agreement that govern your use of Flyhost.in services.

Please read these Terms carefully. By using Flyhost.in services, you agree to be bound by them.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Flyhost (WEBUGGLE INTERNET PVT. LTD.) ("we", "us"), governing your access to and use of flyhost.in and all associated services.
By registering for an account, placing an order, or using any Flyhost service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
2. Eligibility
- You must be at least 18 years of age to create an account or purchase services.
- By agreeing to these Terms, you represent that you have the legal capacity to enter into a binding contract.
- If you are purchasing on behalf of an organisation, you represent that you have authority to bind that organisation.
- Services are subject to availability and may be restricted in certain jurisdictions.
3. Accounts
3.1 Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the accuracy of your account information.
3.2 Account Security
- You are responsible for maintaining the confidentiality of your password and account credentials.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at support@flyhost.in if you suspect unauthorised access.
- We recommend enabling two-factor authentication (2FA) on your account.
3.3 One Account Per Customer
Creating multiple accounts to circumvent account restrictions, abuse free trials, or claim promotions multiple times is prohibited and will result in termination of all associated accounts.
4. Services
4.1 Service Provisioning
Services are provisioned upon receipt of cleared payment. Activation times vary by service type — shared hosting is typically activated within minutes; dedicated servers may take 24–72 hours.
4.2 Service Changes
You may upgrade your plan at any time. Downgrades are processed at the next renewal date. We reserve the right to modify, suspend, or discontinue any service with reasonable notice.
4.3 Resource Usage
Shared hosting plans are subject to fair use limits. Excessive resource consumption (CPU, RAM, I/O, bandwidth) that degrades other customers' experience may result in throttling, migration to a higher plan, or account suspension.
5. Payment & Billing
5.1 Pricing
All prices are displayed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change; changes will be communicated before your next renewal.
5.2 Payment Methods
We accept major credit/debit cards, UPI, net banking, and popular digital wallets via our secure payment processors. International cards are accepted for most services.
5.3 Automatic Renewal
Services renew automatically at the end of each billing cycle unless cancelled before the renewal date. We send renewal reminders at 30 days, 15 days, and 7 days before expiry.
5.4 Late Payment & Suspension
If payment is not received by the due date:
- Services may be suspended after 3 days past the due date.
- Data is retained for 15 days after suspension before permanent deletion.
- A late-payment reactivation fee may apply.
5.5 Taxes
You are responsible for all applicable taxes on services purchased. GST is applied at the prevailing rate for Indian customers. If you are GST-registered, provide your GSTIN in your account for proper invoicing.
6. Acceptable Use Policy
You agree to use Flyhost services only for lawful purposes and in accordance with these Terms. You must not use our services to:
- Violate any applicable Indian or international law or regulation.
- Infringe the intellectual property rights of others.
- Transmit spam, unsolicited bulk email, or SMS.
- Conduct phishing, fraud, or social engineering attacks.
- Distribute malware, viruses, ransomware, or malicious code.
- Launch denial-of-service (DoS/DDoS) attacks against any target.
- Mine cryptocurrency without explicit written approval from Flyhost.
- Operate open mail relays, proxy servers, or anonymous browsing services.
- Store or process sensitive personal data without appropriate security measures.
- Engage in any activity that degrades the performance of shared infrastructure.
7. Prohibited Content
The following types of content are strictly prohibited on all Flyhost services:
- Child sexual abuse material (CSAM) — zero tolerance; immediately reported to law enforcement.
- Pirated software, movies, music, or other copyright-infringing content.
- Illegal gambling, unlicensed lottery, or betting services targeting Indian users.
- Content promoting terrorism, hate speech, or violence against any group.
- Torrenting or peer-to-peer file sharing on shared hosting.
- Counterfeit goods or fraudulent e-commerce stores.
- Any content that violates the Information Technology Act, 2000 (India) or related rules.
Violation of this section will result in immediate account termination without refund and reporting to relevant authorities.
8. Uptime SLA
Flyhost guarantees 99.9% network uptime per calendar month for shared hosting and VPS services, excluding:
- Scheduled maintenance (announced at least 24 hours in advance).
- Events outside our reasonable control (force majeure).
- Issues caused by customer actions, malware, or misconfigurations.
- Third-party service failures (DNS providers, payment gateways, CDNs).
If uptime falls below 99.9% in any given month due to our fault, you may request a pro-rated service credit. Credits must be claimed within 30 days of the incident.
9. Backups
Important: Flyhost performs periodic backups as a courtesy, but these are NOT a substitute for your own backups. You are solely responsible for maintaining independent backups of your data.
- We perform weekly automated backups on shared hosting plans where included.
- Backup restoration requests may incur a service fee.
- We do not guarantee the availability, completeness, or currency of backups.
- We are not liable for data loss under any circumstances — see Section 12.
10. Suspension & Termination
10.1 Suspension by Flyhost
We may suspend your account immediately, without notice, for:
- Violation of the Acceptable Use Policy or Prohibited Content rules.
- Non-payment past the grace period.
- Activity that threatens the security or performance of our infrastructure.
- A valid legal order or CERT-In directive.
10.2 Termination by Customer
You may cancel your account at any time via the Client Area. Cancellation takes effect at the end of the current billing period. Refunds on cancellation are governed by our Refund Policy.
10.3 Data After Termination
Upon account termination, all data associated with the account will be permanently deleted after a 15-day grace period. We strongly recommend downloading all backups before cancelling.
11. Intellectual Property
All content on flyhost.in — including the logo, brand name, website design, marketing copy, and software — is owned by Flyhost (WEBUGGLE INTERNET PVT. LTD.) and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.
You retain ownership of all content you host on our servers. By using our services, you grant Flyhost a limited licence to host, cache, and transmit your content solely to provide the services.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- FLYHOST'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE AFFECTED SERVICE IN THE 3 MONTHS PRECEDING THE CLAIM.
- FLYHOST IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITY.
- FLYHOST IS NOT LIABLE FOR DATA LOSS — MAINTAIN YOUR OWN BACKUPS.
13. Indemnification
You agree to indemnify, defend, and hold harmless Flyhost (WEBUGGLE INTERNET PVT. LTD.) and its officers, directors, employees, and agents from and against any claims, damages, penalties, fines, and expenses (including legal fees) arising from:
- Your use of the services in violation of these Terms.
- Content you host on our servers.
- Your violation of any applicable law or third-party rights.
14. Governing Law & Disputes
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
Before initiating legal proceedings, we encourage you to contact our support team to resolve any dispute amicably. Most issues can be resolved within 5 business days.
15. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on our website at least 14 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
